Tri-County Health Department Public Health Order Requiring Facial Coverings In Public Where Social Distancing Cannot Be Maintained

Summary and Background Information:
In response to the COVID-19 public health emergency, the Tri-County Health Department, which includes Adams County and Commerce City, issued a public health order pursuant to its statutory authority requiring the wearing of face coverings when persons are outside of their residence and unable to maintain social distancing from non-household members. The order describes appropriate face coverings and scenarios in which face coverings must be worn, as well as exceptions from the requirements for certain individuals and scenarios. Businesses and facilities are directed to deny entry to persons not wearing face coverings, unless an exception applies. The order is effective on July 24, 2020, and is effective for 90 days.
Local jurisdictions, including cities and counties, can "opt-out" of the order by July 23, 2020. The City Council could choose to: (1) not opt-out (no action is required); or (2) opt-out (by motion to send a notice to TCHD choosing to opt-out, approved by majority vote). Jurisdictions that opt-out can opt back in at any time. Under extenuating circumstances, additional time to opt-out may be granted.
