Summary and Background Information:
The City of Commerce City developed a Quiet Zone Study in 2007 in response to citizen requests for mitigation of train noise at 8 at-grade crossings along the UPRR and at 6-at grade crossings along the Burlington Northern and Santa Fe Railroad (BNSF) within the City Limits. Safety improvements have been made and a quiet zone established at seven of the eight BNSF crossings, but no safety improvements have been made at the crossings along the UPRR crossings.

The City has been awarded $615,000 in grant funding through federal earmarks for the design and construction of safety improvements at the E. 69th Ave. and E. 72nd Ave. crossings of the UPRR. An IGA is required with CDOT for the administration and use of these funds.

The purpose of this resolution is to authorize the City Manager and the City Clerk to sign and attest an IGA with CDOT for the funding of design and construction of safety improvements at the E. 69th Ave & E. 72nd Ave crossings of the UPRR to establish a quiet zone.

Financial Impact: The total of this agreement is $768,750; $615,000 (80% Federal HIP Award), $153,750 (20% Local Agency, Commerce City Match).
Funding Source: The City has approved ($200,000) which includes their 20% portion of the match in the 2024 Capital Investment Program budget.
