RESOLUTION AUTHORIZING EXECUTION OF MAINTENANCE CONTRACT FOR 104TH AVENUE A/K/A STATE HIGHWAY 44 BY AND BETWEEN THE CITY OF COMMERCE CITY AND THE COLORADO DEPARTMENT OF TRANSPORTATION

Summary and Background Information:
Commerce City has constructed roadway and drainage improvements on 104th Avenue (Hwy 44) between Belle Creek Boulevard and US 85. The city plans to construct roadway and drainage improvements on 104th Avenue between US 85 and Highway 2 in the near future. This contract identifies maintenance responsibilities between the Colorado Department of Transportation (CDOT) and the City of Commerce City for 104th Avenue from Belle Creek Boulevard to Highway 2.
Through this agreement the city is committing to maintain curbs, sidewalks, trails, retaining walls, landscaping, architectural features such as monument columns and graphics, the pedestrian tunnel at the O'Brian Canal, the First Creek channel box culvert, water quality & detention ponds, and other drainage improvements. The city will perform street sweeping, mowing and pedestrian rail painting.
CDOT will maintain the roadway surface, the bridges over I-76, all traffic signals, and signage, and will perform all snow removal.
