A RESOLUTION EXTENDING THE WAIVER OF DEVELOPMENT-RELATED AND OTHER CITY FEES FOR CERTAIN NON-PROFIT ORGANIZATIONS AND AUTHORIZING THE REBATE OF USE TAX COLLECTED FOR CERTAIN NEW DEVELOPMENT BY OR FOR CERTAIN NON-PROFIT ORGANIZATIONS IN THE CITY OF COMMERCE CITY

Summary and Background Information

In 2019, City Council desired to provide greater services to residents by incentivizing non-profit organizations to operate in Commerce City. Resolution 2019-60 achieved this goal by allowing the City Manager to waive and/or rebate certain development related fees for certain types of non-profit development projects. The resolution included a sunset date, and the opportunity for non-profit organizations to request fee waiver and reimbursement without a City Council hearing has ended. Resolution 2022-67 allows for an extension of this opportunity until May 31, 2025. Further, the new resolution includes the same provisions as the original, and allows the City Manager to waive or reimburse the City-imposed development fees, including building permit fees, and rebate non-dedicated City sales/use tax (at the 3.5% rate) payable to the City by or on behalf of a qualifying non-profit entity. All waivers or reimbursement requests will be reviewed by City Manager and Finance staff. At this time, there is one non-profit organization requesting fee reimbursement for their work in Commerce City.

Financial Impact:  No financial impact at this time.  Actual waiver/rebate will be determined at the time a new project is identified.
