A RESOLUTION AUTHORIZING A COST SHARE AGREEMENT BETWEEN REUNION METROPOLITAN DISTRICT (“REUNION”) AND THE CITY OF COMMERCE CITY FOR CHAMBERS ROAD IMPROVEMENTS FROM 104TH AVENUE TO 117TH AVENUE

Summary & Background

Chambers Road was identified within the City of Commerce City’s Transportation Plan (2010) as a recommended candidate for highway widening in order to provide capacity improvements. Chambers Road is classified as a minor arterial throughout the study area. This Project will consist of the segment from approximately 105th Avenue to 116th Avenue, as well as a traffic signal at the intersection with 117th.  The project will include a bridge over Second Creek

 

The Chambers Road typical section will include four (4) through lanes (two in each direction), sidewalks, tree lawns and median. In addition, storm drain improvements will be added.  Right-of-way acquisition may be required, but the extent will be determined through the design process.

 

The engineering design and right-of-way (ROW) acquisitions (if ROW is necessary) are scheduled for 2022 and 2023. Roadway construction is scheduled to start in 2023 and be completed by the end of 2024.  A detailed design schedule for the Project will be prepared by the Contractor, and updated after the City issues a Notice-to-Proceed.

 

The City has been negotiating an agreement with Reunion Metro District (RMD) for the design and construction of the segment south of 112th.  Per direction from Council to complete the widening of Chamber to 117th, the remainder of the project has been added.  This project will be divided into two segments.  The “South also known as (AKA) Shared Road Improvements” extend from E 104th Ave. to E 112th Ave.  The “North - AKA - City Road Improvements” extend from E 112th Ave to E 117th Ave.

 

Elements of agreement and this project include:

-                     Right of Way acquisition

-                     Design and permitting including but not limited to

o                     Pedestrian underpass and bridge replacement at Second Creek

o                     A golf cart/pedestrian underpass at the Buffalo Run Golf Course

-                     Bidding and Contracting

-                     Cost sharing or design, construction and construction management

-                     Operation and Maintenance

-                     City License to Reunion for Construction

-                     Representations and Warranties

This item was originally on the October 17th agenda and was continued by Council to allow more time for public notification and input.  The city received a letter from White Bear Ankele Tanaka & Waldron on behalf of the RMD addressing comments made at the October 17th meeting.  The letter is attached as Attachment 1.

Financial Impact: Current Estimate of City’s portion of the cost is $16.9M.

$13.4M - 2K Cinderella Bonds

$2.9M - 2K Contingency and/or 2K Cinderella Fund Savings

$600K - Buffalo Run Metro District (for traffic signal at 117th or 116th Ave - TBD)

 

Staff Recommendation: Approve the cost share agreement for the Chambers Road improvements from 104th Avenue to 117th Avenue.
