AN ORDINANCE AMENDING ORDINANCE Z-204-79-15 TO REZONE 0.50 ACRES FROM I-2 TO PUBLIC FOR THE PROPERTY LOCATED AT APPROXIMATELY 8600 ROSEMARY STREET AND TRACT A OF INSTEL STEEL WEST SUBDIVISION COMMERCE CITY, COLORADO AND AMENDING THE ZONING MAP OF THE CITY OF COMMERCE CITY, COLORADO TO REFLECT SAID REZONING.

Summary and Background Information

The applicant, South Adams County Fire Department, is requesting the rezone of the entirety of Tract A, Instel Steel West Subdivision. The subject property is approximately 0.50 acres, adjacent to the east of the existing Fire Station No. 4 and fleet maintenance building at 8600 Rosemary Street. The applicant is requesting a rezone from Medium Intensity Industrial (I-2) to PUBLIC in order to be able to expand the existing fleet maintenance building onto the subject property. The existing structures will both remain, with the addition extending to the east of the existing fleet maintenance building. Additional parking and landscaping are proposed with the building expansion. A concurrent development plan and subdivision plat are in the administrative review process. All current regulations and standards will be required to be met with these applications. The proposed rezone is consistent with the future land use indicated in the Irondale Neighborhood and Infrastructure Plan and the goals of the Comprehensive Plan. The Planning Commission recommended one condition with the rezone to ensure that the zoning is consistent with the proposed development. The proposed condition will ensure that the property to be rezoned can be developed as proposed and meets all LDC requirements for development and the PUBLIC zoning district. That condition states “The consolidation plat to combine the existing Fire Station No. 4 property and Instel Steel West Subdivision Tract A shall be completed within nine (9) months of the rezone date.”

 

The Planning Commission has recognized that the proposed zone change and proposed use are consistent with the Comprehensive Plan and Irondale Neighborhood and Infrastructure Plan, will not negatively impact surrounding properties, and will have the potential to positively improve the character of the neighborhood.

Staff Recommendation

On May 12, 2020, the Planning Commission held a public hearing, took testimony, and voted (5 to 0) to forward the zone change request to City Council with a recommendation for approval with one condition, subject to the findings of fact.

 

Suggested Motion

I move that the City Council enter a finding that the requested Zoning for the subject property contained in case Z-204-79-15-20 meets the criteria of the Land Development Code and, based upon such finding, approve the zone change request with one condition:

 

A.                     “The consolidation plat to combine the existing Fire Station No. 4 property and Instel Steel West Subdivision Tract A shall be completed within nine (9) months of the rezone date.”
