AN ORDINANCE AMENDING VARIOUS SECTIONS OF THE LAND DEVELOPMENT CODE

Summary and Background InformationThe Land Development Code (LDC) (Ordinance #1798) was adopted by City Council in January of 2009 and went into effect on March 1, 2009. The LDC was a comprehensive update to the Commerce City Zoning Ordinance, which includes a wide variety of topics dealing with development and land use. Some examples of items in the LDC include application types, zoning districts, use standards, subdivision procedures, design standards, and signage. 

 

Over the course of the last three years there have been periodic minor amendments to the code (approximately every 12 months). The intent of the 2012 minor amendments is to make minor changes, additions, or deletions to the LDC in order to continue to meet the needs of the community. Major revisions to the LDC (i.e. signage, oil and gas, and alcohol regulations) have not been included in this round of amendments and will be addressed as part of a separate revision process to those individual sections.

 

The proposed minor amendments for 2012 total 28 items that can generally be characterized in four categories. The first category includes updates for legal clarification, the second category includes updates that are necessary to further align the LDC with the City’s Building Codes, the third category includes amendments that are necessary to keep the LDC modern, and the fourth category includes amendments that have been identified by the community as a need.

 

Staff will continue to monitor the LDC through 2012 and track items that arise in order to make necessary changes in the future.

Recommended City Council Actio Planning Commission recommends that City Council approve the 2012 minor amendments to the LDC.

 

Ordinance Update:A change has been made to the ordinance since first reading. In paragraph (h) of Section 6, we have changed the title “Substance Abuse Treatment Facility, Outpatient Residential” to “Substance Abuse Treatment Facility, Outpatient Clinic” and we have corrected an error in drafting to reflect that such a use is a use-by-right in the C-2, C-3, and I-1 zone districts, not a conditional use.  These changes are redlined in the attached ordinance.  All other items, as previously discussed remain the same.
