RESOLUTION AMENDING RESOLUTION APPROVING ECONOMIC DEVELOPMENT INCENTIVE FOR PETER DEFRIES

On October 5, 2015, City Council approved business incentives for the Peter DeFries Corp. to establish a Dion's Pizza in the Aspen Hills development.  The company expected to have the new Dion’s Pizza open by December 31, 2016, so that date was included in the original resolution and incentive agreement as a performance term. Dion’s Pizza officials have moved the opening date back six weeks and have asked for an amendment to the original agreement to reflect this.

 

Dion’s updated its construction schedule as company representatives worked with the land owner and city staff on development requirements at Aspen Hills unique to their project.  For example, City staff proactively examined and changed the city’s zoning ordinances in early March to support Dion’s parking requirements. The company expects to break ground this summer but will wait to train new staff until after the holidays. An opening is expected in early 2017.

 

The original intent of incentivizing this project was to attract a new restaurant to Commerce City and have it be the second project for the company in the metro Denver area.  Both of these conditions are still accurate if the City makes the date modification that Dion’s Pizza is asking for.

Financial ImpactNo financial impact at this time. Business incentives have been estimated based on the company's stated capital investment.  Actual incentive rebate amount will based on actual capital investment and determined after the company is open for business.

Funding Source:  Business incentives will be funded as a rebate of certain fees and/or sales and use tax remitted to the city in conjunction with this project.
