RESOLUTION APPROVING LEASE AGREEMENT WITH COMMERCE CITY CULTURAL COUNCIL, INC.

Summary and Background Information:
In conjunction with the 2K efforts, the Conter facility was offered to the Cultural Council and the Historical Society as a possible location for their operations. Before occupying the space, a lease agreement is needed to protect the interests of all parties. Staff has been meeting with representatives of both groups in an effort to negotiate the terms of these leases.
As background, the Historical Society would still utilize the former gas station facility for storage. Both the Historical Society and Cultural Council would have access to Conter for:
- Events, such as fundraising
- Exhibits, such as an art or historical show
A conference room would be available for both groups, and Historical Society would also use one of the offices full time. Outside groups could also use the space through an application process. As the landlord, the City would be responsible for maintaining a calendar of events and providing notice. During an exhibit, the organizations would be responsible for having people on site, which would likely result in set hours for visitation, especially by the Historical Society.
The name of the facility would be the "Commerce City Heritage and Cultural Center." Signage would have the facility name with two name plates of each organization below
City will provide insurance of the facility, and each group would provide insurance for their contents. City would be responsible for maintaining the building and grounds, including providing janitorial services.
These would be two year leases, with an option to renew annually by either party. For the historical society, the rent starts at $100/month, increasing by $100 every year thereafter, capping at $500/month. For the Cultural Council, the same terms would apply, with the rent amounts being $10/month, increasing $10 every year thereafter, capping at $50 per month.

Financial Impact: The City will subsidize the operations through services and the payment of certain utilities, totaling approximately $1,130 per month. Conversely, the City will receive rent payment every month, starting at $110 per month capping out at $550 per month.
