AN ORDINANCE AMENDING THE 2024 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF GRANT FUNDING FROM THE COLORADO DEPARTMENT OF TRANSPORTATION (CDOT) IN THE AMOUNT OF $3,840,000 FOR THE WIDENING OF 88TH AVENUE IN THE CITY OF COMMERCE CITY AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF

Summary & Background

The City entered into an Intergovernmental Agreement (IGA) with the Colorado Department of Transportation (CDOT) in May of 2021. The original IGA provided for a total of $4 million, $2 million in Federal Surface Transportation Block Grant (STBG) funding with a $2 million local match for the 88th Avenue Widening Project. A 1st Amendment to the IGA occurred in May 2022. This amendment increased the $2 million of STBG funding to $3 million and reduced the local match requirement from $2 million to $1 million. A 2nd Amendment to the IGA occurred in September 2023 and provided additional Federal Transportation Alternatives Program (TAP) funding and State Multimodal Transportation and Mitigation Options (MMO) funding along with associated local match requirements.

 

A summary of this IGA history and associated funding is detailed in the table below. The total local match requirement is currently $1,960,000 and can be covered by existing local resources included in this capital project line item.

 

 

The $3 million in Federal STBG funding provided through the 1st Amendment to the IGA was recognized and appropriated into the City’s Capital Expenditures Fund budget for this project via Ordinance No. 2421. City Staff initially brought Ordinance No. 2564 forward to recognize the entire $6,840,000 in Federal and State funding, which was passed by Council on First Reading during the 2/5/24 Council meeting. Staff has revised Ordinance No. 2564 to only recognize the new $3,840,000 million ($1,440,000 in Federal TAP funding and $2,400,000 in State MMO funding) that has yet to be recognized, for Final Reading on 3/18/24. The full amount of $6,840,000 in Federal and State funding does not need to be recognized, since the $3,000,000 in STBG funding was previously recognized at part of Ordinance No. 2421.

 

The additional funding provided through the 2nd Amendment to the IGA with CDOT will be used for construction improvements along E. 88th Avenue between I-76 and Highway 2. The scope of this project includes:

                     Widening 88th Avenue from 2 lanes to 4 lanes with appropriate turn lanes and median, if needed.

                     Upgrading the traffic signal at the intersection of 88th Avenue with Rosemary Street and interconnect all signals between I-76 to the signal at Rosemary Street and the signal at Highway 2.

                     Constructing sidewalks along both sides of the roadway and add adjacent bike path in accordance with the City’s adopted Bike-Walk-Fit plan.

                     Accommodate the planned 60-inch storm sewer planned by Urban Drainage and Flood Control District (UDFCD) identified in the Outfall Systems Plan Conceptual Design Report in September 2011.

 

The goals of this project include:

                     Provide improved roadway conditions between I-76 and Highway 2; and

                     Provide lighting, landscaping and drainage improvements; and

                     Provide sidewalk and curb ramps; and

                     Improve safety for pedestrians and cyclists.

 

Ordinance No. 2564 was also revised to better document the history of related Council actions related to this CDOT IGA. Please see below for a complete list of Council actions related to this matter.

 

 

Additional efforts are underway to identity and allocate additional resources to this project. Additional amendments to the IGA with CDOT to incorporate additional funding along with an IGA with Adams County to provide a funding contribution are anticipated. Staff will bring these additional items forward to Council as they are finalized.
